Kobe Bryant's prosecutors said Wednesday he will be put on trial later this month but attorneys for the 20-year-old accuser are indicating that their client could decide not to continue cooperating in the case.
She will reportedly have to talk with prosecutors about whether she will go forward with the state's criminal case against Bryant. The recent release of court documents that refer to her sex life could preclude her from fair treatment at trial, her lawyer contends.
Could she opt out of participating in the case at this stage? "That's something she and prosecutors will have to discuss in the immediate future," the attorney told the media. "The DA's office will have to make that decision on what they want to do."
"Nothing has changed with our plans of going forward with the prosecution of this case," a prosecutor said. "The impression I got was that the victim needs to have strong resolve."
Bryant has pleaded not guilty to felony sexual assault, saying he had consensual sex with the woman. If convicted, Bryant faces four years to life in prison or 20 years to life on probation, and a fine of up to $750,000.
The attorney for the alleged victim said she is considering a civil case against Bryant, where the standard of proof is lower and the penalty is monetary damages.
"This young woman is not going away. Whether it proceeds criminally or civilly or both, justice is going to be had for this young woman," the attorney said.
