Alan Hahn of Newsday first reported that the players have voluntarily dismissed the California lawsuit filed against the NBA last week. The players are consolidating all their legal action in Minnesota, where another suit was filed last week.

"This should permit us to expedite the case," players' attorney David Boies told the media.

Additional players will be added to the list of plaintiffs.

"This is now a consolidated class action on behalf of all the players," Boies said. "If we had not done this, the courts would've done it."

Boies said that there has been no movement toward a settlement between the two sides.

He reiterated that a settlement would be preferable to litigation but indicated that initiating contact with the NBA now would be a waste of time.

"It's probably going to take a while for them to decide that they're prepared to negotiate," Boies said.

But speaking to Chris Sheridan of SheridanHoops later, Boies admitted that it may not be a bad idea to give the league a call, perhaps by Wednesday.
