The NBA has decided to not upgrade the flagrant foul one committed by Dwight Howard in Game 4.

Howard elbowed Andrew Bogut and some said it could be upgraded to a flagrant foul two, which would have resulted in a suspension for Howard.

"Howard was trying to extricate himself from Bogut and recklessly hit him the face with an open hand. The contact was unnecessary but not deemed excessive by the officials working the game with the aid of the replace center. And we don't see a reason to modify that," said Rod Thorn.
